Abstract

The implications of artificial intelligence are complex when it comes to criminal liability. In fact, even with a seemingly simple example like self-driving cars, it's not easy to determine how criminal law will address the problems these new technologies raise. In this particular case, will the car manufacturer be liable for dangerous driving or fleeing the scene of an accident? Or will the person behind the wheel be? Or perhaps the car itself? While these questions may seem hypothetical or far-fetched, they will likely end up in court sooner than we expect. General principles of criminal liability can help answer these questions. By analyzing these principles, we will attempt to offer some avenues of thought regarding this issue.
