Abstract

This study examines tamadhhub (adherence to a Sunni legal school) from the perspective of Islamic legal theory (uṣūl al-fiqh) and the higher objectives of Islamic law (maqāṣid al-sharīʿah). Rather than revisiting the classical debate over whether adherence to a particular legal school is obligatory or whether movement between schools is permissible, the study reconceptualizes tamadhhub as a structured methodology for juristic formation and legal education. It investigates whether madhhab-based training constitutes the most effective means of cultivating juristic competence and preserving the continuity of Islamic legal scholarship.

The research employs descriptive, analytical, historical, and inductive methodologies. It examines the historical emergence of the four Sunni legal schools, analyzes the theoretical foundations governing legal means (wasāʾil) in uṣūl al-fiqh, and draws upon historical evidence from the intellectual trajectories of leading jurists, biographical literature, and major educational institutions that shaped Islamic legal learning across successive generations.

The study argues that tamadhhub should be understood not as an independent legal objective, but as a methodological means whose normative value derives from its effectiveness in achieving the higher objective of acquiring juristic competence. Inductive evidence demonstrates that the overwhelming majority of eminent jurists and independent mujtahids received their formative legal education within established madhhab traditions before attaining advanced levels of legal reasoning and independent judgment. Furthermore, the study maintains that legal maxims governing means—particularly the principle that "whatever is indispensable for fulfilling an obligation assumes the ruling of that obligation"—provide a sound jurisprudential basis for recognizing tamadhhub as a legitimate and highly effective educational methodology.

The study further distinguishes tamadhhub from sectarian partisanship and blameworthy taqlīd (blind imitation). It contends that classical critiques were primarily directed against rigid adherence to opinions despite contrary evidence, rather than against madhhab-based legal education itself. Consequently, tamadhhub is presented as a methodological framework that historically contributed to preserving legal methodology, safeguarding scholarly authority, and ensuring the transmission of juristic reasoning across generations.

Originality/Value: The originality of this study lies in shifting the discussion of tamadhhub from the normative debate over legal obligation to an examination of its epistemological and educational function. By framing tamadhhub within the theory of legal means and the objectives of Islamic law, the study offers a new analytical perspective that explains its enduring role in preserving Islamic legal knowledge and producing qualified jurists.
