Historical Development of Administrative Environmental Protection Laws in Libya

In this research, we examined the historical development of administrative environmental protection laws in Libya by outlining the legislative evolution witnessed by the Libyan legal system in the field of environmental protection. It was found that the Libyan legislator paid attention to the protection of the environment and its components at an early stage through a set of general and special legislations that included scattered provisions aimed at preserving environmental elements and ensuring the safety of the natural and built environment, prior to the issuance of a unified environmental law regulating administrative environmental protectionin a comprehensive manner.
The research also demonstrated that Libyan legislation did not overlook the various aspects related to human life and the environment; rather, it sought to regulate them in a way that achieves the public interest and preserves public health and safety. Despite the delay in establishing an integrated environmental legislative framework, the legislator witnessed remarkable development through the enactment of special environmental protection laws and the introduction of preventive administrative mechanisms that contribute to limiting environmental pollution and degradation.
Furthermore, we concluded that the effectiveness of administrative environmental protection is not confined merely to the existence of legal provisions; rather, it also depends on the administrative authorities entrusted with their implementation. In this regard, the Libyan legislator established a number of central and decentralized bodies and agencies and granted them the necessary powers to formulate environmental policies and plans, monitor the implementation of environmental legislation, and ensure its practical enforcement, thereby contributing to the achievement of environmental stability, the sustainability of natural resources, and the protection of society from various environmental risks.
