The Role of the Security Council in Politicizing the International Criminal Court

Abstract

This study examines the role of the United Nations Security Council in politicizing the International Criminal Court by analyzing the powers granted under the Rome Statute and their impact on the Court’s independence, impartiality, and effectiveness in prosecuting international crimes. It proceeds from the assumption that the institutional relationship between the Security Council and the Court, particularly through referral and deferral of investigations or prosecutions, has created opportunities for political considerations and the interests of permanent members to prevail over international criminal justice. The study discusses the effect of Article 16 of the Rome Statute on suspending Court proceedings, the Council’s role in determining the crime of aggression, and the granting of immunity to certain nationals of non-State Parties, contrary to the principle that official capacity is irrelevant. It also highlights selectivity and double standards in dealing with international situations by comparing the rapid referral of the Libyan situation in 2011 with the absence or obstruction of referrals in other situations involving violations of international humanitarian law. The study further considers the Court’s response to allegations of crimes committed against civilians by NATO in Libya and evaluates the adequacy of investigations. Using analytical and critical methods, it concludes that the Security Council’s extensive powers and interest-driven decisions have weakened the Court’s image as an independent judicial body and contributed to selective justice and impunity. It recommends regulating the Council–Court relationship, restricting referral and deferral powers, strengthening legal oversight, and ensuring equal application of international criminal law without discrimination or exception.
