Abstract

Disciplining employees is a necessary measure in the public service sector; disciplinary action and penalties serve as means to prevent laxity in the performance of duties and to curb the disciplinary infractions committed by employees while carrying out their tasks.

Moreover, the severity of a disciplinary penalty imposed on a public servan-particularly when it is prolonged or its consequences are harsh-can demoralize the employee and stifle their creative spirit, ultimately reflecting negatively on the work itself. ...the public service, and the image it projects of the administration and the state within society. To ensure that this disciplinary sanction does not remain a sword hanging over the public employee's head, legislators in both Egypt and Libya have established specific grounds which, if met, result in the termination of the disciplinary sanction imposed on the employee. In some instances, the decision to apply these grounds rests with the administration; one such example is the expunging of the disciplinary sanction, whereby the effects of the penalty cease to impact the public employee's future.

. The rationale behind the provision for expunging a penalty is to open the door to redemption for the disciplined employee who committed a transgression, encouraging them to conduct themselves properly and rectify their past errors. This is a noble and legitimate objective—one recognized by the legislature in the context of criminal offenses, which are far more serious than administrative infractions—and it necessitated the establishment of a system for the rehabilitation of employees who have faced disciplinary sanctions within the civil service. This is particularly relevant when it is demonstrated that the employee has made a genuine effort to reform and maintain proper conduct. We will examine the system for expunging disciplinary penalties imposed on employees under both Libyan and Egyptian law. Our analysis will cover the concept and forms of disciplinary penalties, the definition of expunging such penalties for public employees, and the procedures, conditions, and competent authorities involved in this process. Finally, we will discuss the methods and legal effects of expunging disciplinary penalties for public employees.
